LinkSports International Corp.(“LinkSports”, “we”,or “we”) respects your privacy, and we want you to understand how we may collect personal information about you through our websites:  https://linksports, https://payments.linksports and  https://linkports.com/brazil   (each “Site” and collectively, “Sites”), and how this information may be used, maintained and, in some cases, shared. This privacy policy (“Privacy Policy”) sets out the privacy practices and policies that govern our Sites.

“Personal Information” means any information that allows us to identifyyou, directly or indirectly, by reference to an identifier, such as your name, identification number, location data, online identifier or one or more factors specific to you. Information we collect and how we use

The following describes the types of personal and other information we may collect about you and how we use and maintain that information:

 

Information you provide to us

LinkSports collects and retains personal information about you, including name, email address, physical address, telephone number or other personal or background information when you voluntarily submit it to us. If you submit information related to an event or championship listed in https://linksports.com, in addition to contact information we may collect your date of birth, sports history, height, weight, age, as well as information about references you identify.

Before using some parts of our websites, we may require you to request access to those parts by providing us with your contact information, a username and password. If you provide us with a phone number or an email address, you expressly agree that we, or our authorized agents, may use this information to contact you about your access request or account, or about LinkSports and  its associated activities.

LinkSports collects information reported by individuals and entities as part of its regulatory activities, which may include personal information, such as report entities’ personnel names, email addresses and addresses, telephone numbers. If you submit other people’s personal informationto LinkSports,you represent and warrant that you have the necessary consent or authority to do so.

We may retain any information you provide to us indefinitely.

 

Social networking activities

Our sites may allow you to sign in to social networking sites such as Facebook, YouTube, Instragram, TikTok and Twitter. If you choose to follow, type, friend, share or comment on our social media sites, or share information on these social networking sites, we may receive information about you. We may use this information about you in a variety of ways, including improving your experience with the disclosure ofLinkSports  and to communicate withyou about new activities d aLinkSports.

We can keep all this information indefinitely.

 

Financial Transactions

If you pay annual or registration fees using the “Registration, or, Subscribed to an Annual or Premium Subscription (“SAPS” system, you will be involved in a financial transaction through our SAPS Website, https://SAPS.linksports.com. In any transaction, you will be asked to provide certain financial information to effect a bank transfer. We do not retain your account and routing numbers. We may transfer you to third parties for payment processing. We use technology designed to encrypt data transmission to us through the system, as well as financial information we receive, transfer or maintain. If you submit financial information through https://payments.linksports.com all such data is sent directly and securely to a third-party payment processor; LinkSports  does not retain any financial information submitted through https://payments.linksports.com. Consult the CET prior to the contracting of the financing.

 

Site usage information

LinkSports may collect technical information regarding each time a visitor arrives at our websites, including the IP address of visitors to our Sites. This information is considered personal information under this Privacy Policy. We may also collect information about your use of our Sites, including number of visits, average time spent on the Sites, pages viewed, page response times, download errors, duration of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to navigate away from the page, and any phone number used to connect to us. Gathering this information helps us improve the content we offer. You do not need to register on our websites before we can collect this information. We may share with third parties this information or other data on an aggregate basis without the use of any personally identifiable information.

 

How we use information

We use your personal information in accordance with the terms of the Privacy Policy in force at the time of our use. We will only process your personal information, including by sharing it with third parties, where (1) you have provided your consent that may be withdrawn at any time, (2) processing is necessary for the performance of a contract to which you are a party (including your registration or agreements with us), (3) we are required by law, (4) processing is necessary to protect your vital interests or those of another person,  or (5) processing is necessary for the purposes of our legitimate commercial or regulatory interests, provided that your interests and fundamental rights do not overdo those interests.

  1. We use the personal information you give us, which we collect through social networking activities, and that we receive through financial transactions in SAPS:
    1. to fulfill our obligations arising from your registration and any other agreement entered into between you and us;
    2. to identify you and communicate with you;
    3. to update and communicate with you about your account as needed;
    4. to provide you with the information and services you request from us;
    5. carry out our regulatory activities and conduct research and analysis;
    6. to answer your questions and provide related services;
    7. improve linksports sites;
    8. to improve your experience with the disseminationof LinkSports;
    9. to communicate with you about new or existing activities and other information that LinkSports believes  to be relevant and useful to your visitors, where you have not chosen not to receive such information;
    10. to send you information from third parties that LinkSports believes  is relevant and useful to you, where you have given your consent;
    11. to notify you of changes to our related activities or services or ask you to provide feedback;
    12. to allow you to attend a conference, seminar, or complete a survey;
    13. to manage and protect our business and websites (including troubleshooting, data analysis, testing, system maintenance, support, reporting, and data hosting); or
    14. to sue and consider it for employment at LinkSports.
  2. We use the aggregated and anonymous data of use of the site collected to perform statistical analyses of the collective characteristics and behavior of visitors to the Sites; measure the user’s interests in relation to specific areas of the Sites; and analyze how and where to best use our resources. Without this data, we would not know which parts of the Sites are the most popular, and we would not be able to properly change and update the content and services.

 

Cookie Policy

Like most websites, we may employ “cookies” or similar technologies on certain pages of our Sites. Cookies facilitate the use of the Sites by saving your preferences. We may also use cookies to provide content tailored to your interests. Web beacons allow us, for example, to monitor how users move from one page within our websites to another, to track access to our communications, to understand whether users came to our sites from an online ad displayed on a third-party website, to measure how ads were viewed and improve website performance.

We don’t use technology that recognizes a “do not track” signal from your browser, because we don’t track users other than for aggregate statistical purposes.

 

Opting out of communications

If you have signed up or are receiving news from LinkSports or similar information from us by email and no longer wish to receive such information in the future, you may choose not to receive such emails by clicking the “unsubscribe” link at the bottom of the emails you receive or on the unsubscribe page on the Sites. Please note that even if you choose not to receive emails, you may still receive communications related tolinksports supervision activities or otherwise as required by law. Please note that we may need to keep the information we collect about you for registration, research, and other purposes.

 

Disclosure of information to third parties

We will not share, rent, sell or disclose any personal information we collect about you through our Sites, except in any of the following situations or described in this Privacy Policy:

  • You request or authorize the release of your personal information.
  • We may disclose personal information to our contracted third parties and payment processors performing services for us in connection with the Sites, or to complete or confirm a transaction or series of transactions you conduct with us. We may also disclose personal information to service providers or suppliers if disclosure allows that party to provide business, professional or technical support to us.
  • We may disclose personal information as part of a transfer of assets or interests relatedto LinkSports. We do not guarantee that any entity that receives such information in connection with one of these transactions will comply with all the terms of this Privacy Policy.
  • We may disclose personal information to comply with applicable law, regulations, government and near-governmental requests, court orders or subpoenas, or to enforce our Terms of Use or other agreements, or to protect our rights, property or security or the rights, property or safety of our users or others. We reserve the right to disclose information we collect to law enforcement or other government officials, as we, in our sole and absolute discretion, we consider necessary or appropriate.
  • In accordance with our regulatory function, we post on our Sites certain information reportedto LinkSports by  individuals and entities, which may include personal information, such as employee names of reporting entities, business addresses and correspondence, telephone numbers. The individual or reporting entity is responsible for obtaining any consent or authority necessary for the disclosure of such personal information.
  • We may also share aggregated or anonymous information that cannot identify you with third parties. For example, we may disclose the number of visitors to our sites or the number of people who downloaded a specific document.

 

Safety

We use technology designed to encrypt the transmission of data to us through our websites, including through our SAPS system, through https://linksports.com through https://payments.linksports.com and https://linksports.com/brasil. In addition, we take steps to protect all user data we collect from any unauthorized access. However, you should keep in mind that the Sites run on software, hardware, and networks, any component that may, from time to time, require maintenance or experience issues or security breaches beyond our control.

While we take steps to protect your personal information and keep it secure, you also play a role in protecting your information. You must maintain the security of your online transactions by not sharing your passwords and account information with any unauthorized parties.

Please also be aware that despite our best intentions and guidelines described in this Privacy Policy, no internet data transmission or encryption method can be guaranteed as 100% secure. LinkSports cannot  guarantee the security of any information you transmit to us or our Sites and therefore you use our websites at your own risk.

 

Links to other sites

Our sites may contain links to other sites, including social media sites hosted by third-party providers; however, this Privacy Policy only addresseslinksports’ use and disclosure of your information collected through our Sites, if any. If you choose to link to an external site of our site, you will leave our Site. We are not responsible for the privacy practices of third parties or the content of linked sites. We encourage you to read the applicable privacy policies and terms and conditions of such parties or websites.

 

Children’s privacy

If you are under the age of 16, you will be required, for your registration, as well as the maintenance of any of your data, the consent and authorization of your legal representative, to access the full functionality of our Sites. It is not our intention to collect or use personal information from anyone under the age of 16, and we will only do so with consent and within the law. If we become aware that we have collected any personal information from children under the age of 16 and are asked to delete that information from our system, we will do so promptly.

 

Consent to transfer outside information to Canada

If you access websites outside canada, the information we collect about you will be transferred to servers within Canada and maintained indefinitely, which may involve transferring information outside your home country. By allowing us to collect information about you, you agree to this transfer and processing of your data.

We will not collect your personal information through the Sites unless you have voluntarily provided or the collection is in accordance withLinkSports’ regulatory activities  or is consistent with this Privacy Policy. In situations other than those listed in this Privacy Policy, you will be informed whether your personal information will be disclosed to third parties and you will have the opportunity to opt out of such disclosure unless such disclosure to third parties is in accordance withlinksports’ regulatory activities or is required by law.

 

Government Law

By choosing to visit our websites or provide information to us, you agree that any dispute over privacy or the terms contained in this Privacy Policy will be governed by the law of the State of New York. You also agree to abide by any limitation of damages contained in our Terms of Use or other agreement we have with you.

We may occasionally change this Privacy Policy to reflectlinksports’  activities and user feedback and reserve the right to make changes to this Privacy Policy at any time. If at any time we decide to use personal information in a manner materially different from that stated at the time it was collected, we will endeavour to notify you of such changes before implementing it by posting a revised Privacy Policy with a new “Last Updated” date, displaying the word “updated” next to the Privacy Policy link on each page of the Sites or otherwise. Use of your information is subject to the Privacy Policy and Terms of Use in force at the time of use. The provisions contained in this Privacy Policy supersede all prior notices or policies about our privacy practices in relation to our Sites. Updates to this Agreement

We may revise or amend or update this Agreement. Please check the caption “Last updated” at the top of this page to see when this Agreement was last revised. The changes will take effect immediately after they are published. A current version of this Agreement showing the effective date is always available here. We encourage you to periodically review this Agreement to see if there have been any changes that may affect you. If you do not agree to this Agreement as modified, then you must discontinue use of the Sites. Your continued use of a Site will signify your continued agreement for this Agreement, as it may be revised from time to time.

 

Authorized use

By using a Site, you are required to comply with all applicable statutes, orders, regulations, rules and other laws.   • Sell, resell or otherwise exploit for any commercial purposes, use or access to a Site or any portion thereof withoutlinksports’ prior writtenconsent;
  • If you impersonate any person or entity, falsely state or misrepresent your affiliation with any person or entity in connection with a Site, or express or imply that we endorse any statement you make;
  • Remove any copyright, trademark or other proprietary rights of the Sites or materials originating from the Sites;
  • Violate or attempt to violate the security of a Site;
  • Spread on a website any viruses, worms, spyware, adware, or other malicious computer code, file or program that is harmful, invasive, or that may or is tweded to damage or hijack the operation or monitor the use of any hardware, software, or equipment;
  • Use any data mining, bots, spiders, automated tools or similar methods of collecting and extracting data, directly or indirectly, on a Site or to collect any information from a Site or any other user of a Site; or
  • You help or allow anyone to violate this Agreement or statutes, orders, regulations, rules, and other applicable laws governing your use of the Sites.

 

Intellectual Property Rights

All content (“Content”) available through the Sites is protected by copyright, trademark, or other proprietary rights and laws. Except as set forth herein or otherwise agreed in writingby LinkSports  or other rights owners, the use of any Content available on a Site is strictly prohibited.

LinkSports seeks to ensure that public accounting companies, issuers, brokers, resellers, investors and the general publichave ready access to LinkSports rules andstandards,as well as toforms, releases, requests, notices, guidelines, reports, papers and similar materials that  LinkSports  discloses to the public through the Sites (“LinkSports  “). Subject to third-party copyrights noted on the Sites,  LinkSports  therefore permits and will not assert claims of copyright infringement based solely on the use, publication, display or distribution of all or any portion of such  LinkSports Public Materials.

You may use the LinkSports Public Materials of the Sites explicitly madeavailable by LinkSports  for public use, provided that you (a) keep intact all copyrightand other proprietary notices; b Use the  LinkSports Public Materials in  accordance with any associated licenses; c Obtain the consent of any applicable party with respect to the copyright of any third party,  as needed, (d) use appropriate attribution when possible (for example, “Source:  LinkSports,www. LINKsports); (e) make no modifications to the LinkSports PublicMaterials; f Donot make additional representations or warranties regarding The LinkSports Public Materials on behalfof LinkSports;and (g) do not use the  LinkSports Public Materials  in a manner that LinkSports  deems inappropriate or inadvisable in its sole discretion.

All rights granted herein are expressly granted.

 

Information submitted by the user

You are responsible for any content you transmit through our websites. You agree, represent and warrant that any content you transmit through our Sites or to us is true, accurate, unmisleading and offered in good faith, and that you have the right to transmit such Content. You shall not upload, post or make available on or through a Site any Copyrighted Content, trademark or other proprietary right of any third party without the express written permission of the owner of such rights or authority to do so. You will be solely responsible for any damages resulting from any infringement of copyright, trademark or other proprietary rights, or any other damage resulting from such submission.

We do not want you to submit, and you shall not, send any confidential or proprietary content to us unless (a) it is transmitted in accordance withlinksports’ regulatory activities;b Specifically requested byus, includingas part of a job applicationwith LinkSports;or (c) provided as tips/referrals/complaints,  including those submitted through our Reference Center. Please note that any content submittedto LinkSports  other than the terms (a)-(c) above will be deemed non-confidential or proprietary.

By submitting content, in addition to personally identifiable information or bank account information related to payments made through the Sites, you grantLinkSports (or warrant that the owner of such Content has expressly grantedLinkSports) aroyalty-free, perpetual, irrevocable and unrestricted right and license to use, reproduce, display, modify,  adapt, publish, transmit, distribute or make available to other such content (in whole or in part and for any purpose) worldwide and/or incorporate it into other works in any form, media or technology now known or developed below; b Exercise all copyrights, trademarks, publicity, privacy and other proprietary rights in relation to such content; and (c) use your name, likeness and/or other biographical information in any and all media and/or communications. You also agree that  LinkSports is free to use any ideas, concepts, know-how or techniques you submit to us for any purpose.

 

Secure user accounts

Certain parts of our sites are accessible only to users who have been granted access and have received login credentials (“Secure Users”). If you are a Secure User, you agree to accurately maintain and update any information about you and your account that you have providedto LinkSports.

You further agree that you are responsible for all activities that occur in your Secure User account. You are responsible for maintaining the confidentiality of your login credentials and agree not to share your login credentials with any unauthorized parties. You also agree to promptly notify us of any unauthorized use of your login credentials or any other security breach that you are aware of involving or relating to a Site by sending us an email to [email protected]

LinkSports reserves the right to take any and all action, as it deems it necessary or reasonable to maintain the security of the Sites and your account, including without limitation, terminate your account, change your password or request information to authorize transactions in your account.

WE EXPLICITLY DISCLAIM RESPONSIBILITY FOR ANY LOSS AND DAMAGE ARISING FROM YOUR FAILURE TO COMPLY WITH THIS SECTION.

 

Changes to the Sites

We may make improvements and/or changes to the Sites, add or remove features, or terminate a Site at any time without notice. We (a) reserve the right (but we have no obligation) to change the Content or other offers on the Site at any time without any notice or liability to you or any other person; and (b) do not warrant that the information on the Sites is accurate, complete, reliable, current or error-free. Some jurisdictions may not allow exclusions and exemptions from certain implied warranties, so some of the provisions in this section may not apply to you.

 

Third-party content

Any information, statements, opinions or other Content provided by third parties and made available on our Sites are those of the respective authors and notlinksports. Under no circumstances  will LinkSports  be liable for any loss or damage caused, directly or indirectly, by its reliance on any third-party content.

LinkSports may provide links to third-party websites on the Sites only as a convenience to users. If you use these links, you will leave our websites. If you decide to visit any linked website, you do so at your own risk and it is your responsibility to take all protective measures to protect yourself against viruses or other destructive elements.  LinkSports makes  no warranty or representation about, or endorse or sponsor, any linked websites or the information appearing therein or any of the products or services described. The links do not imply that LinkSports  is legally authorized to use any trademark, trade name, logo orcopyright symbol displayed or accessible through the links, or that any linked site is authorized to use any trademark, trade name, logo or copyright symbol ofLinkSports.

Social Media Pages

LinkSports may maintain a presence on social media sites, including Facebook, YouTube, LinkedIn and Twitter (collectively, “Social Media Pages”), to provide a place for the public to learn more about LinkSports  and share comments. All comments, visuals and other materials posted by visitors to our Social Media Pages do not necessarily reflect the opinions or ideas ofLinkSports. All visitors to our Social Media Pages must comply with the respective Terms of Use of the social media site. We’ve reviewed some, but not all of the posts on our social media pages, and may remove posts that we may find inappropriate or offensive.

 

Copyright Infringement Notice

If you believe that any content on a Site infringes any copyright you own or control, you may send a written notice containing the required information in the form of the law and regulations of your own to our Designated Copyright Agent as set forth below.

Additional policies and terms may apply to the use of all or parts of the Sites and are incorporated by reference into this Agreement. Please review and review all additional specific terms and conditions as applicable, includinglinksports’ Privacy Policy,which describes how we collectand use information about and through the Sites.

 

Termination

The Sites and this Agreement are in effect until the endof the year by LinkSports. In addition to any right or remedy that may be available to LinkSports  under applicable law, and subject to regulatory requirements,  LinkSports may suspend, limit or terminate all or part of your access to the Sites or any of its remedies at any time with or without notice and with or without cause,  including, without limitation, if  LinkSports believes that you have violated or acted inconsistently with the letter or spirit of this Agreement. The provisions of this Agreement relating to authorized use, intellectual property rights, information submitted by you, disclaimer of warranty, limitation of liability and indemnification, as well as any other provisions that, by their nature, must survive, survive any termination.

You agree that if your use of the Sites is terminated in accordance with this Agreement, you will not attempt to use a Site under any name, actual or assumed. You further agree that if you violate this restriction after your use of the Sites has ended, you will indemnify us and hold us harmless from any and all liability we may incur. We reserve the right to prosecute all violators to the fullest extent of the law.

 

Children’s privacy

If you are under the age of 16, you will be required, for your registration, as well as the maintenance of any of your data, the consent and authorization of your legal representative, to access the full functionality of our Sites. It is not our intention to collect or use personal information from anyone under the age of 16, and we will only do so with consent and within the law. If we become aware that we have collected any personal information from children under the age of 16 and are asked to delete that information from our system, we will do so promptly.

 

Warranty Disclaimer

LinkSports DOES NOT WARRANT OR MAKE ANY REPRESENTATION SO ABOUT THE USE, VALIDITY, ACCURACY, RELIABILITY OR OTHERWISE RESPECTING THE CONTENT AVAILABLE ON THE SITES OR ANY OTHER LINKED SITES OR THE SITES. DOWNLOAD OR OBTAIN ANY CONTENT THROUGH THE SITES IS DONE AT YOUR OWN RISK. THE CONTENT OF THE SITES IS PROVIDED “AS IS” AND ON A “AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY EXPRESS OR IMPLIED TYPE. To THE EXTENT POSSIBLE, IN ACCORDANCE WITH APPLICABLE LAW,  LinkSports  DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES OF COMMERCIALIZATION, FITNESS FOR A SPECIFIC PURPOSE AND NON-FRUITION.

 

Limitation of Liability

LinkSports AND EACH OF ITS DIRECTORS, DIRECTORS, DIRECTORS, EMPLOYEES, AGENTS AND CONTRACTORS (COLLECTIVELY, THE “POSTINGS”) SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR RELATED TO THE USE OR INABILITY TO USE THE WEBSITES, CONTENT OR LINKS OF THE SITES, INCLUDING BUT NOT LIMITED TO DAMAGES CAUSED OR RELATED TO ERRORS,  OMISSIONS, INTERRUPTIONS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, COMPUTER VIRUSES OR LINE FAILURES. THE POSTINGS SHALL NOT BE OF ANY RESPONSIBILITY FOR ANY Acts, OMISSIONS OR CONDUCT OF ANY USER OR THIRD PARTIES.

THE POSTINGS SHALL ALSO NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES, EVEN IF THEY HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

IF ANY PORTION OF THIS LIMITATION OF LIABILITY IS FOUND TO BE INVALID OR UNENFORCEABLE FOR ANY REASON, THEN THE AGGREGATE LIABILITY OF RELEASES SHALL NOT EXCEED ONE HUNDRED DOLLARS (US$100).

 

Indemnity

You agree to indemnify and hold harmless LinkSports and its board members, directors, directors, employees, agents and contractors from and against any and all claims, damages, losses, costs (including, without limitation, reasonable attorneys’ fees) or other expenses arising directly or indirectly out of or from (a) your violation of any provision of this Agreement; b Your activities in connection with the Sites; or (c) unsolicited information that you  linksportsthrough the  Sites.

 

Consent to Communication

If you provide us with a phone number or email address, you expressly agree that we, or our authorized agents, may use that number or email address to contact you.

When you use the Sites or send emails to LinkSports,you are communicating with  LinkSports  electronically. You agree to electronically receive any communications related to your use of the Sites. We may communicate with you by email or by posting notices on the Sites. You agree that all agreements, notices, disclosures and other communications that are provided to you electronically satisfy any legal requirement that such communications be in writing. All notices toLinkSports intended for receipt by a user in connection with the Sites will be deemed delivered and effective when sent to the email address provided by the user on the Websites or through the Sites.

 

Effect of Invalidity

In the event that a court has jurisdiction finds any part of this Agreement unenforceable, that portion shall not be effective and the remainder of this Agreement shall remain effective.

 

Waivers

No waiver, express or implied, by any party of any breach or default under this Agreement shall constitute a continuous waiver of such breach or default or shall be deemed a waiver of any prior or subsequent breach or default.

 

International Users

The Sites are controlled, operated and administeredby LinkSports  (or its licensees) of its offices within Ontario, Canada and are not intended to subject LinkSports to the laws or jurisdiction of any state, country or territory other than CANADA. LinkSports DOES  NOT REPRESENT OR WARRANT THAT THE SITES OR ANY PART OF THEM ARE APPROPRIATE OR AVAILABLE FOR USE IN ANY PARTICULAR JURISDICTION OTHER THAN CANADA. Those who choose to access the Sites do so on their own initiative and at their own risk, and are responsible for complying with all applicable statutes, orders, regulations, rules and other laws of applicable jurisdictions.

 

Choice of Law

You agree that any dispute relating to the Sites, this Agreement or the Privacy Policy will be governed by the laws of Ontario, CANADA. You also agree to the judgment of any disputes arising out of the Sites, this Agreement or the Privacy Policy in the state and federal courts of Canada.
